Avoiding & Managing Sibling Conflicts in Estate Matters (June 18, 2026)

We will be discussing the sources and cause of sibling estate fights, how to avoid and manage them and a discussion of whether you should go to court or settle via mediation.

Estate mediation is an important part of the estate litigation process. Most lawsuits settle well in advance of trial. Many people believe that appearing in Court and having a verdict from a Judge is the desired outcome when a lawsuit is commenced.

But mediation may be a better option as it provides the parties the opportunity to control the process as opposed to putting their fate in the hands of a total stranger.

Moreover, the estate litigation process is very lengthy and expensive. It can take many years of emotional and financial costs to litigate a metter all the way to trial. Mediation can greatly shorten the length of the Court proceedings and significantly reduce the legal fees involved.

Most estate disputes can be resolved well in advance of trial as long as the parties involved are willing to be reasonable and compromise.

Speaker: Charles Ticker

Charles B. Ticker is a mediator and former estate litigator with over 40 years of experience. He now restricts his practice to mediation of estate disputes. He received a B.Sc. (Hons Psychology) from McGill University and an LLB from Osgoode Hall Law School. He was called to the Bar of Ontario in 1980.

He received training as a mediator at Harvard Law School in 2007. Charles has appeared as counsel at all levels of Court in Ontario. He is a member of the Canadian and Ontario Bar Associations (Trusts and Estates and ADR sections) and the ADR Institute of Ontario. He has chaired and spoken at several legal conferences on estate issues and mediation. He publishes a blog “The Sibling Fight” which deals with sibling disputes in estate matters.

He has produced a CD set entitled “How to Make the Most of Your Mediation” and has written a book (published June 2019) entitled Bobby Gets Bubkes: Navigating the Sibling Estate Fight. Charles spends his free time volunteering for charities and playing keyboards with his garage band “The Faded Genes”.

In 2013, he was awarded the Queen Elizabeth II Diamond Jubilee Medal. Charles has been listed in the 2021 through 2024 editions of Best Lawyers in Canada for Trusts and Estates.

The cost of caregiving includes both the expenses borne by care recipients and the physical, emotional and financial impact on caregivers. Care recipients face cost for healthcare services, medications, home care and LTC which are only partially publicly funded.

Caregivers often provide unpaid support, leading to lost income, reduced work hours and increased stress or burnout. Out of pocket expenses, such as transportation, home modifications, and supplies further burden both groups.

These costs vary across provinces due to differences in healthcare coverage, availability of home care and LTC systems. Provinces with fewer services or older populations tend to place greater reliance on informal aka family caregiving. The impact creates an impact on broader society.

I have more than 25 years of experience helping clients manage their wealth and hold the Certified International Wealth Manager (CIWM) and Chartered Investment Manager (CIM) designations. My focus and passion on aging has been guided by my personal experiences following a series of family emergencies including the prolonged death of my father and a catastrophic accident that has left my mother in a wheelchair needing around the clock in-home care. I began my work in the field of Gerontology in 1993 after graduating from the University of Western Ontario and McMaster University with degrees in Psychology and Gerontology, and having a career in long term care. More recently, I have completed the Certified Patient Navigator program from York University, and the death doula training provided by Home Hospice Association. During the pandemic I completed a certificate program in Thanatology to get a better on what holds us back in planning for aging and end of life.

Alter ego trusts and joint partner trusts were introduced in 2001 and have become essential wealth and succession planning tools for Canadians 65 and older. However, a comprehensive update incorporating 20+ years of CRA interpretations, case law, and current planning challenges would be valuable.

The 65-year age requirement and rollover mechanics under the Income Tax Act

Subsection 75(2) reversionary trust rule concerns and how to avoid them

Loss of LCGE eligibility (unlike spousal trusts)
