What is the difference? Power of Attorney (POA) vs Executor

These two roles are frequently confused, but they serve very different purposes and operate at completely different times in a person's life.

Power of Attorney (POA)

A POA is a legal document that grants someone (or "agent") the authority to act on your behalf while you are alive. (https://www.canada.ca/en/employment-social-development/corporate/seniors-forum-federal-provincial-territorial/power-attorney-financial.html)

When it's active: During your lifetime and typically when you're incapacitated, unavailable, or simply want someone to handle affairs on your behalf

What they can do: Manage bank accounts, pay bills, make financial or legal decisions, sign documents, and (with a healthcare POA) make medical decisions

Types: General, Limited, Durable (survives incapacity), and Healthcare/Medical POA

Key point: A POA is automatically extinguished the moment you die. The agent's authority ends immediately at death

Executor (or Estate Trustee)

An Executor is a person named in your Will who is responsible for administering your estate after you die.

When it's active: Only after death, and usually once the Will is probated (validated by the court)

What they can do: Gather and protect assets, pay debts and taxes, file a final tax return, and distribute the estate to beneficiaries according to the Will

Appointed by: The deceased, via their Will (or by a court if there is no Will)

Key point: Their authority begins at death; exactly where the POA's authority ends

Why the Confusion?

People often name the same trusted person for both roles, which makes it seem like one job. But legally, they are entirely separate. It's also common to mistakenly believe that a POA gives someone authority to handle your affairs after death; it does not. Without a Will naming an Executor, your POA agent has no legal authority whatsoever once you pass.

It is best to consult a notary or estate lawyer for advice specific to your situation. You can find an advisor in our Directory.

What Is An Executor?

In Canada, an executor (called a liquidator in Quebec or an estate trustee in Ontario) is the person or entity designated in a will to manage a deceased person’s estate.

Think of them as the "project manager" of someone’s life after they pass away. It’s a significant role that carries both legal authority and a fair amount of paperwork.

Core Responsibilities

An executor is legally obligated to act in the best interest of the estate and its beneficiaries. Their duties generally follow this timeline:

Funeral Arrangements: Usually the first task, ensuring the deceased’s wishes are honored.

Locating Assets: Finding bank accounts, property titles, investments, and insurance policies.

Applying for Probate: This is a court process that confirms the will is valid and officially grants the executor the power to act. (https://www.ontario.ca/page/apply-probate-estate)

Paying Debts and Taxes: The executor must use the estate's money to pay off outstanding credit cards, mortgages, and critically file the final tax returns with the Canada Revenue Agency (CRA).

Distributing the Estate: Once all debts and taxes are cleared, the executor distributes the remaining assets to the beneficiaries according to the instructions in the will.

Who Can Be an Executor?

In Canada, you have a few options for whom you can appoint:

A Family Member or Friend: Often a spouse or adult child. They know the family dynamics but might find the legal/financial side overwhelming.

A Professional: Such as a lawyer or accountant.

A Trust Company: Often used for complex estates or when there is a high chance of family conflict.

Important Considerations

Liability: Being an executor isn't just a "title." You can be held personally liable if you distribute money to beneficiaries before paying the CRA or if you mismanage the assets.

Compensation: Because it is a lot of work (often taking 12 to 18 months), Canadian law generally allows executors to charge a fee for their services, usually a small percentage of the estate's value. This amount varies by Province.

The Right to Refuse: Just because you are named in a will doesn't mean you must do it. You can "renounce" the role, provided you haven't started dealing with the assets yet.

Have you been appointed as executor of a will? Get professional advice from one of our members in your area. See our Directory here.

What Is Estate Planning? (A Comprehensive Guide for Canadians)

Updated: March 30th, 2026

This is a general overview and is not applicable to everyone. We recommend finding an accredited Estate Planner in your province by finding one in our directory.

Estate planning is the process of organizing your financial, legal, and personal affairs so that your wishes are carried out if you become incapacitated or after you pass away.

In Canada, estate planning ensures that your assets—such as property, investments, businesses, and personal belongings—are distributed according to your wishes while minimizing taxes, legal complications, and stress for your loved ones.

A well-structured estate plan can help to preserve your wealth, ensure your wishes are known and followed, and secure your legacy. (source - Doane Grant Thorton 2026)

This guide explains how estate planning works in Canada, the key documents involved, and why it’s important for individuals and families at every stage of life.

WHY ESTATE PLANNING IS IMPORTANT IN CANADA

Many Canadians assume estate planning is only necessary for the wealthy or elderly. In reality, anyone with assets, dependents, or specific wishes about their healthcare or finances should have a plan in place.

Without an estate plan, provincial laws determine how your assets are distributed. This can lead to unintended outcomes, higher costs, and delays for your family.

Key benefits of estate planning include:

· Ensuring your wishes are respected regarding asset distribution

· Protecting children and dependents

· Reducing estate taxes and probate costs

This means:

5 Tips To Stop Putting It Off And Finally Start Writing Your Will

Estate planning isn't complicated. Your process is.

If you’ve been putting off writing your will, you’re likely overthinking it.

Here are 5 tips to cut through the noise and get it done:

1. Keep it private. You don't need a committee to decide your personal affairs. Opinions create noise; privacy creates focus.

2. Kill the "Perfect Timing" myth. Don't wait for January or next Monday. Progress begins the second you decide to start.

3. Curate your influences. If the people around you aren't talking about legacy or responsibility, find the digital communities that are. Follow discipline, unfollow distraction.

4. Remove the emotion. Treat this as a checklist, not a therapy session. Stop making it a "big deal" and just make it a task.

5. Hire a pro. Don't gamble your legacy on a DIY template or an online forum. Consult a lawyer to ensure your wishes actually have legal teeth.

Stop gambling on uncertainty. Get it done today.

Estate lawyers are also required to confirm and settle any debts and liabilities, file appropriate tax returns on behalf of the deceased and the estate, and distribute assets to beneficiaries in accordance with the Will if one exists. This means accurate estate valuation is essential.
